Colorado Ground Water Commission


The Colorado Ground Water Commission is a regulatory and an adjudicatory body authorized by the General Assembly to manage and control designated ground water resources within the State of Colorado.  The General Assembly has granted the Ground Water Commission this authority under Title 37, Article 90 of the Colorado Revised Statutes (Ground Water Management Act). Currently the Colorado Ground Water Commission has established 8 Designated Ground Water Basins.


Notice

The Commission has received a petition from the Morgan County Quality Water District that the Commission initiate the process to amend Rule 5.2.5.2 so as to determine that the Hay Gulch drainage within the northern portion of the Lost Creek Designated Ground Water Basin is overappropriated. A rulemaking hearing before the Commission is scheduled for May 21, 2010. The Commission has transferred the matter to its Hearing Officer for fact finding proceedings to be conducted before that hearing occurs. Please refer to the Notice of Public Rulemaking Hearing for details on participating in and obtaining Party Status to the proceedings. The Commission has received a petition from the Lost Creek Land & Cattle Company, Equus Farms Inc., and the Lost Creek Ground Water Management District that the Commission initiate the process to amend Rule 5.2.5.2 so as to determine that the Lost Creek main stem drainage within the northern portion of the Lost Creek Designated Ground Water Basin is overappropriated. A rulemaking hearing before the Commission is scheduled for August 20, 2010. The Commission has transferred the matter to its Hearing Officer for fact finding proceedings to be conducted before that hearing occurs. Notice

The Commission has received a petition from the Northern Colorado Water Association to initiate the process to create a new designated ground water basin to be known as the Upper Spring Creek Designated Ground Water Basin, in Larimer County. The petition and its exhibits are attached below. In its August 21, 2009 meeting the Commission authorized Staff for the Commission to commence with publication of the petition and remanded the matter to its Hearing Officer for Fact Finding Proceedings. The petition is being published in the Fort Collins Coloradoan newspaper on October 16 and 23, 2009. The publication, which contains a legal description of the proposed basin, and a map prepared by the State Engineer showing the lands proposed to be included in the basin, are attached below.
A pre-hearing setting conference concerning the petition will commence on November 24, 2009 at 10:00 a.m. at 1313 Sherman Street, Room 318, Denver, Colorado 80203. All persons wishing to state either support or objection to formation of the proposed designated ground water basin shall provide written notice to Joseph (Jody) Grantham, Hearing Officer, Colorado Ground Water Commission, 1313 Sherman Street, Room 818, Denver, Colorado 80202 no later than November 23, 2009. Written notice of objections to or in support of designation must briefly state the nature and basis of the objection or support.

Notice

The Commission has received a petition from the Upper Big Sandy Ground Water Management District to initiate the process to amend Rule 5.2.7.1 so as to re-define the extent of the alluvial aquifer in the Upper Big Sandy Basin, and to amend Rule 5.2.7.2 so as to determine that the alluvial aquifer in the Upper Big Sandy Basin is overappropriated. Attached is the petition.
